ChilliFreak.com (CF) Terms and Conditions of purchase
1. Your order and purchase is made on the basis of the terms outlined here in full. They may not be modified or altered in any way.
2. Your order and purchase are governed by the Laws of Western Australia. Each party unconditionally submits to the jurisdiction of the State of Western Australia only.
3. You warrant that the details you provide for the purposes of this web site are correct.
4. If you are acting on behalf of a company or as an agent you warrant that you have actual authority to enter into this agreement. You indemnify all actions against CF if it is found that you do not have the required authority.
5. By entering this site and this agreement you give your express approval for the CF to obtain information required to complete your order and purchase. You agree to CF’s use of cookies in enabling the operation of the site as outlined in the Privacy and security statement.
6. The CF will treat as private any information that you submit in the course of your dealings with the CF through the web site in accordance with the Privacy and security statement. The CF will not deal with your provided information except as is required to process your order and purchase and as the CF is otherwise required to deal with your information as required by law.
7. You agree to the cost, indicated as the "Grand Total" figure, in Australian Dollars (AUD) as is outlined in the "Shopping Cart" facility.
8. Your selection of item/s that you have identified on the "Shopping Cart" facility is at law considered to be an invitation to treat. An offer is constituted, on the terms outlined in this statement, on the basis of your selection and the indicated total purchase price. Your acceptance will be indicated by you clicking on the "Pay Now" button. By clicking the "Pay Now" you indicate your intention to accept these terms and conditions as part of your order and purchase.
9. Once your acceptance is communicated to CF you will be required to complete the transaction by authorising CF, through a credit card payment service facility provided by PayPal to debit your account according to the stipulated price in the "Shopping Cart" facility.
10. Any taxes that apply to this transaction are those that would apply to the transaction as if it were conducted in the State of Western Australia.
11. CF accepts no liability whatsoever for any loss whether caused directly or indirectly through the use of this web site or through contracting with CF over the Internet. You agree to assume the full risk of contracting with CF over the Internet and indemnify CF for any and all losses you incur.
12. CF accepts no liability whatsoever for any actions by third parties that interfere with this transaction. You acknowledge that technical difficulties may interfere with the operation of this transaction and assume this risk in accepting this offer.
13. If by reason of any fact or circumstance, matter or thing beyond the reasonable control of CF or you as the purchaser, either is unable to perform in whole or in part any obligation under this agreement that party is relieved of that obligation under this agreement to the extent and for the period that it is so unable to perform and is not liable to the other party to this agreement in respect of such inability.
14. If any provision of these terms and conditions is deemed to be illegal, invalid, void or voidable, the validity of the remainder of the terms and conditions will not be affected and will continue to be in force and have effect
Return Policy
* Please check all items on arrival for any damages or missing items.
* If items are delivered in bad condition, DO NOT sign the packing slip that goods were received in good condition.
* If items are received in bad condition, you have the right to refuse delivery, the goods will then be sent directly back to Chilli Freak's head office.
* All claims must be made within 7 days of delivery.
* Claims must be received in writing, quoting the invoice number and reasons/details.
* No returns are accepted without Chilli Freak's prior approval and delivery instructions.
* We do not refund or exchange for change of mind.
